Based on the Federal Law on the Protection of Personal Data Held by Private Parties in effect in Mexico (“the Law”), we inform you that this Personal Data Privacy Notice (“Notice”) describes how R. H. & R. UNIVERSAL, S. C., with address at: 76 North Street, Block 402, Lot 07, between 35 North Street and 40 North Street, Luis Donaldo Colosio Murrieta Neighborhood, Playa del Carmen, Solidaridad, Quintana Roo, and its subsidiary companies and/or business units or branches “R. H. & R. UNIVERSAL, S. C.”, may collect and use information provided by you through various means or the website “www.rhr-universal.com”, in order to facilitate the administrative and labor management of employees. 

This is based on Article 1 of “the Law”, which establishes that “its purpose is to protect personal data held by individuals in order to regulate their legitimate, controlled, and informed treatment, in order to guarantee privacy and the right to informational self-determination of individuals.” 

Purposes for which your personal data will be used.

R. H. & R. UNIVERSAL, S. C., constantly concerned with improving the quality of its labor relations with its employees, is responsible for handling the personal data provided by you, as well as for the use and protection thereof. In accordance with this notice, R. H. & R. UNIVERSAL, S. C. may, among other things, handle, share, store, transfer, and make such data available to authorities or third parties. 

The personal data we collect about you are necessary to verify and confirm your identity, as well as to administer and operate human resources processes within the company. 

These data are also used for internal control of personal knowledge and skills, to comply with obligations arising from the employment relationship you have with “R. H. & R. UNIVERSAL, S. C.”, to create labor and medical records, to contact your family members, dependents, and/or beneficiaries in case of emergency, to comply with the provisions stipulated by labor laws (employer-employee), as well as laws and regulations of relevant institutions such as the Mexican Social Security Institute (IMSS), the National Workers’ Housing Fund Institute (INFONAVIT), the National Commission of the Retirement Savings System (CONSAR), the National Fund for the Consumption of Workers (INFONACOT), and the Tax Administration System (SAT).

For security purposes, the company’s facilities will be video-recorded 24 hours a day, 365 days a year.

Personal data collected and used about you.

“R. H. & R. UNIVERSAL, S. C.” may collect and, where applicable, process the following personal data: full name, date of birth, age, gender, marital status, nationality, address, fingerprint (for biometric use), copy of official identification with photograph (passport, voter ID card, professional license), curriculum vitae; job application, marriage certificate, Form 37 Salaries and Wages, INFONAVIT retention notice, bank account opening agreement, driver’s license, credit bureau report, medical exams, non-criminal record certificate; copy of birth certificate; copy of proof of address (utility bills, phone bills, or property tax bills); copy of released military service record (if necessary); personal phone number, cell phone number; copy of Tax Identification Number; copy of Unique Population Registry Code (CURP); social security number; education certificates or study records; language proficiency certificates or records; employee category (level) and position; photograph; personal references; emergency contact information; employee performance information; certificates of previous employment; copy of AFORE affiliation certificate; letters of recommendation. 

Family and/or family members’ data: R. H. & R. UNIVERSAL, S. C. may request personal data of your family members in order to have information to communicate with them in case any of our employees have an incident during working hours. Similarly, personal data of family members will be required to extend the benefits of the Life Insurance. Video surveillance and photography: Every person entering the premises of R. H. & R. UNIVERSAL, S. C. may be recorded by our security cameras and may also be photographed. 

The images captured by the closed-circuit television system will be used for your security and that of the people visiting us, in order to remotely monitor the premises and promptly identify any risk conditions to minimize them. Additionally, this is done to safeguard the material and human resources within our facilities. The photographs are intended for access control purposes to our corporate premises.

Sensitive personal data that we will use. 

In addition to the personal data mentioned above, for the purposes stated in this privacy notice, we will use the following personal data considered sensitive, which require special protection: health status, diseases you have, allergies, and medications you are currently taking at the time of signing your corresponding contract, patrimonial and financial data, credit history; copy of marriage certificate (if necessary); copy of immigration document (if necessary); salary, earnings, and deductions; copy of the Mexican Social Security Institute (IMSS) registration, termination, or salary modification certificate; copy of the last job’s earnings certificate; information related to beneficiaries or economic dependents, which may include full name, date of birth, and other identification data, such as copies of birth certificates; copy of mortgage credit certificates (INFONAVIT). These will be treated as sensitive data in accordance with the guidelines established by “the Law.”

Who we share your personal data with.

As a result of the employment relationship, “R. H. & R. UNIVERSAL, S. C.” may share, for eventual transmissions or transfers of your personal data, with companies within the group to which “R. H. & R. UNIVERSAL, S. C.” belongs, as well as with third parties that, due to the administration of human resources, social security, and benefits provided by the company, require such transfer, such as doctors, clinical laboratories, socioeconomic studies, insurance companies, gasoline voucher management companies, retirement plan administrators, to the extent permitted by “the Law,” who are obliged and must independently comply with the legal privacy provisions regarding your data. 

In any case, we will communicate this privacy notice to the recipients of your personal data, so that they respect its terms. Likewise, “R. H. & R. UNIVERSAL, S. C.” may disclose your personal data in response to requests for information from competent authorities. 

As you are part of the employee roster of “R. H. & R. UNIVERSAL, S. C.,” you expressly consent to the information collected (your personal and sensitive data) being transferred to external professional advisors or providers such as doctors, clinical laboratories, socioeconomic analysts, retirement plan administrators mentioned above. In any case, we will communicate this privacy notice to the recipients of your personal data, so that they respect its terms, and they are obliged to independently comply with the legal privacy provisions. 

If you do not wish your personal data to be transferred to other companies within the group to which “R. H. & R. UNIVERSAL, S. C.” belongs, you have the right to express it. 

The disclosure and transmission that may be established in the future will be subject to the express consent you provide hereby in accordance with the terms and duration established in “the Law,” also observing the provisions of articles 518 and 519 of the Federal Labor Law, even if the legal relationship between the parties has concluded. 

This privacy notice may undergo modifications, changes, or updates due to new legal requirements, our own needs for the products or services we offer, our privacy policies, changes in our business model, or other causes. In such case, we commit to keeping you informed of any changes that may occur in this privacy notice through the “Portal,” where the date of the latest version of the notice will be indicated. Therefore, we recommend that you periodically visit the mentioned page to be informed if any changes occur. You may request a review, modification, deletion, or exercise of your rights under applicable privacy laws regarding the personal information we have about you, subject to certain restrictions under “the Law.”
